Two-Stage Process

How the Partner Visa Works

The partner visa is a two-stage process. The Subclass 820 is a temporary visa that allows you to stay in Australia while your application is assessed. The Subclass 801 is the permanent partner visa, usually granted around 2 years after the initial 820 application.

Both applications are lodged at the same time — you pay for and submit both together. The 820 is typically processed first, allowing you to remain in Australia, and the 801 is considered once you've been in the relationship for 2 years.

Not Yet Married?

Subclass 300 — Prospective Marriage Visa

If you're engaged but not yet married, the Subclass 300 Prospective Marriage Visa allows your fiancé to come to Australia to get married. Once married, your partner can apply to remain in Australia on a partner visa (820/801).

The Subclass 300 requires evidence of your genuine intention to marry and that both parties are free to marry under Australian law.
